Property Mediation Process
Step 1. Individual Intake Session
As with Parenting, Property mediation begins with an individual intake session to understand your unique circumstances, identify the issues to be discussed and assess whether mediation is suitable, including any safety considerations
Step 2. Property Mediation
The mediation follows a structure that supports discussions around:
- identifying the property pool
- considering contributions made into the property pool, both financial and non-financial
- considering contributions and future needs
- assessing whether proposals are just and equitable.
Property mediation can create room for solutions that are more flexible and personal than simply dividing assets on a page. It allows people to talk through what matters to them, including the emotional and sentimental value attached to the family home, belongings and other property.
Linda takes a holistic approach, guiding people to consider practical options that reflect their circumstances, priorities and what feels workable for the next stage of their lives.
Step 3. Next Steps
Where agreements are reached, these can be recorded clearly and in good faith as a summary of the outcomes discussed during mediation.
Alternatively, if the agreements reached in mediation are to be formalised and made legally binding, the next steps can be discussed.
The aim is to support fair, workable agreements that both parties understand and can move forward with.
